     I understand that this medical history will become part of my personal file and any evidence of falsification, misrepresentation, or omission of information will be considered adequate cause for discharge. Furthermore, I understand that this questionnaire is for the purpose of enabling my employer to fulfill the requirements of the South Carolina Second Injury Fund, and it is in no way connected to the Companies decision to hire me. This information provided is not to be used by the company as basis of denying me placement within the Company or promotion, or to discriminate against me in any way.     Program Terms and Conditions. / GM Participant’s Obligations & Responsibilities: GM Participant’s Obligations & Responsibilities:
    1. Prior to my departure, I will read all written materials sent to me by GM. 
    2. In the event of the termination of my contract by GM, GM will be responsible for my return travel to my home country.
    3. I will not pay any job placement fee to any agency or entity in connection with my temporary employment with GM.
    4. GM will be responsible for USCIS filing fees.
    5. I will be responsible for passport fees.
    6. I certify that I will follow any instructions from GM before and during my stay in the U.S. and I will comply with applicable laws, regulations, and/or instructions of appropriate government agencies in the United States.
    7. I certify that the information given in this form is complete and accurate.
    8. I have read, understood and agree to follow all of GM’s policies and I agree to complete and abide by this GM Participant Agreement, GM Structured Training Plan established between GM and myself.
    9. I will not voluntarily leave GM during the course of this agreement; nor will I seek employment in any other U.S. company/firm/organization or attempt to enroll in an educational institution/university/college while I am enrolled in the GM Program. 
    10. I understand that this program will only sponsor me for up to the time specified in the visa, after which I must return to my home country.
    11. I certify that I have a residence in a foreign country that I have no intention of abandoning, and I am coming to the U.S. temporarily without any intent to immigrate to the United States.
    12. I understand that I must apply for my visa at the American consulate in my home country.
    13. I am qualified to perform the service or labor or receive the type of training stated in the I-129 petition.
    14. I understand that I can only be employed by the Grandeur Management through which I attained the appropriate nonimmigrant status.
    15. I understand that it is not necessary for me to apply for an employment authorization document; I further understand that any employment outside this specific program violates the terms of my  nonimmigrant status within the meaning of the Immigration and Nationality Act Section 237(a)(1)(C)(i).
    16. I further understand that although GM’s affiliate hotels and resorts are used as locations where I will work on a daily basis, GM as a management company will keep total control of scheduling, monitoring and performance evaluations of all my activities.  It is this aspect of control that truly demonstrates that GM remains my Employer at all times.
    17. I further understand that this agreement does not allow me to work directly with the ACP Property or any intermediary vendor whatsoever. GM has a no-solicitation and no-compete agreement with the work site and intermediary vendor (if any) and any breech of this clause will result in penalties up to $10,000 paid to GM by the participant.
    18. I understand that I may make brief departures from the U.S. without having to obtain a new visa with approval from GM. However such periods of time spent outside the U.S. will not be added to the end of my stay.
    19. I certify that I have never associated with nor have ever been a member of any communists or terrorist’s organizations; and have no intent of engaging in any such activity.
    20. I have never been in any deportation or exclusion proceedings, nor ever violated the terms of a U.S. visa or other admission or travel document or passport.
    21. I have never been convicted of a crime in the U.S. or any country, nor currently have any criminal proceedings pending against me.
    22. I further understand that although GM’s affiliates are used as locations where I will consult on daily basis, GM will be my employer. It is this aspect of control that truly demonstrates that GM remains my Employer at all times.
    23. I understand that GM declines any legal responsibility for any incurred health problems or any personal misconduct or inappropriate behavior by the participant.
    24. I understand that GM declines any legal responsibility for participants terminated from the program.
    25. I understand that GM declines any legal responsibility for any forces of nature, any force major or any unforeseen acts of God.
    26. GM reserves the right to change the work property location of the participant with or without notice depending upon business fluctuation, performance issues or other unforeseen circumstances.
    27. In case of serious disciplinary issues as outlined in GM Employee Handbook, participant’s employment will be immediately terminated and s/he should be given 24 hours to vacate the provided housing. Please refer to GM Employee Handbook for complete disciplinary and performance procedures.
    28. I understand that I can be deported and permanently excluded from the United States if I’ve ever committed fraud or willfully misrepresented a material fact for the purpose of obtaining a visa from GM.
    29. I declare that I have no intention of remaining the U.S. after the period allowed by this program.
    30. I understand that I must provide my valid Social Security Number and card, a valid photo ID and my I94 card to Grandeur so Grandeur can verify my eligibility for employment. Failure to provide these documents will result in delay of my paycheck and termination of my employment agreement.
    31. Since I have not been interviewed face to face by Grandeur Management, there may be another interview face to face with the property supervisor for housekeeping or another position after my arrival in the USA. GM reserves the right to terminate its contract with me based on the outcome of this interview. It is often observed by Grandeur that applicants promise to work in all departments however as soon as they enter the USA, they show no willingness to work and show no motivation during the face to face interview. Grandeur will take a strict notice of such behavior.
